The Esseks Ingoglia team has represented companies and executives in a wide range of matters, facing all parts of the Federal government, and in civil litigation arising from those matters.

White Collar Individual Representations

Our team has represented corporate executives in criminal and regulatory investigations, enforcement actions, and trials regarding alleged financial fraud, market manipulation, insider trading, money laundering, sanctions, corruption, and antitrust violations. Examples of our prior representations include:

  • Defended a hedge fund partner at trial in the Southern District of New York on criminal insider trading charges, winning acquittals on the principal insider trading charges and reversals on appeal of improper convictions

  • Defended the CEO of a crypto-lending business in connection with inquiries by the Department of Justice (DOJ) and Securities and Exchange Commission (SEC), resulting in no action brought against our client
  • Defended a university professor in a Title VI investigation by the Department of Health and Human Services (HHS), resulting in no action brought against our client

  • Defended the head of public relations at a public company in connection with an SEC investigation and subsequent civil litigation into allegations of accounting fraud and insider trading

  • Defended at trial the former speaker of the New York State Assembly, Sheldon Silver, in a criminal re-trial for honest services fraud and Hobbs Act extortion

White Collar Corporate Representations

Our team has represented U.S. and multinational public and private companies and financial institutions in investigations and enforcement actions led by various government authorities including the DOJ, SEC, Commodity Futures Trading Commission (CFTC), New York Department of Financial Services (DFS), National Futures Association (NFA), Port Authority of New York and New Jersey (PANYNJ),  U.S. Department of the Treasury's Financial Crimes Enforcement Network (FinCEN), FINRA, among others.  Our team’s prior experience includes:

  • ​Defended BitMEX, a market-leading crypto-currency derivatives trading platform, against criminal and regulatory Bank Secrecy Act investigations and enforcement actions

  • Defended global investment banks in myriad investigations by the DOJ, SEC, CFTC, NFS, DFS, and others concerning, among other things:

    • alleged fraudulent practices in the FX market

    • alleged corruption in hiring practices in Asia

    • alleged manipulation of interest rate swaps

    • alleged sanctions violations

    • alleged money laundering and Bank Secrecy Act compliance issues

  • Defended a public company in an insider trading investigation by the SEC

  • Defended a public company in an investigation by the DOJ into allegations of accounting fraud

  • Defended an airport services company in connection with a NY Attorney General’s Office commercial bribery investigation

Internal Workplace Investigations

Our team has conducted internal workplace investigations for many corporations and financial institutions.  Our team’s experience includes:

  • Conducted an internal investigation for a public company into allegations of sexual misconduct by an executive

  • Conducted an internal investigation for a tech company into allegations of gender and racial bias

  • Conducted an internal investigation for a special litigation committee of a public pharmaceutical company’s board of directors in connection with allegations of executive misconduct raised in a shareholder derivative lawsuit

  • Conducted an internal investigation for a healthcare company into allegations of executive misconduct

Complex Civil Litigations

Our team has represented individuals, corporations, and financial institutions in complex civil litigations, including class action lawsuits, at the trial and appellate levels in state and federal courts.  Our experience includes:

  • Defended BitMEX, a market-leading crypto-currency derivatives trading platform, in a putative class action in the Southern District of New York, in which the action was voluntarily dismissed without any relief against any defendant

  • Defended the CEO of a crypto-lending business in connection with litigations following DOJ and SEC inquiries

  • Defended investment banks and other clients in various putative class actions in the Southern District of New York and other federal courts concerning the trading of financial instruments

  • Represented individual members of management of a public company in a commercial litigation

  • Obtained discovery for foreign individuals and companies seeking discovery in the United States for use in foreign tribunals through 28 U.S.C. § 1782
